Sunset Beach Villa – Full Legal Disclaimer

(For Website, Direct Bookings, and All External Booking Platforms)

1. Acceptance of Terms

By making a booking at Sunset Beach Villa, the guest (“You”) confirms that they:

- have read, understood, and accepted all House Rules, Policies, and Disclaimers; and

- agree that these terms apply regardless of where the booking was made, including:

  • the villa’s official website,

  • Airbnb, Booking.com, or any online travel platform,

  • any rental agent or third-party agency, or

  • direct communication with the hosts.

Your stay at the property constitutes full and binding acceptance of all terms listed here and within the House Manual (available for viewing at the house)

2. Use of the Property at Your Own Risk

You acknowledge that you make use of the villa, its facilities and surrounding areas entirely at your own risk. This includes, but is not limited to:

  • Swimming pool and pool deck

  • Pool mat and wooden pool deck cover

  • Wood-fired hot tub and firebox

  • Stairs, balconies, railings, and elevated areas

  • Braai areas, fireplaces, and outdoor cooking equipment

  • Outdoor showers and garden areas

  • Beach access paths and dune reserve

  • Wind, sand, natural conditions, wildlife, or other environmental factors

The owners, hosts, and property managers assume no liability for injuries, accidents, loss, or damages resulting from your stay, including those arising from negligence, rule violations, improper use of facilities, or natural conditions.

Parents and guardians are responsible for supervising children at all times.

3. Property Damage & Fees

Guests agree to treat the villa and its contents with care. You are financially responsible for:

  • any damage caused to the villa or its contents,

  • misuse of appliances or equipment,

  • damage to pool mechanisms, pool cover, deck panels, outdoor furniture, doors, or windows,

  • damage caused by pets,

  • any additional cleaning or restoration required due to negligence.

Damages will be charged at fair replacement or repair cost. Guests must report any damage immediately.

4. Security, Cameras & Personal Belongings

Outdoor-only security cameras are installed for safety and monitoring external areas. There are no indoor cameras and no continuous real-time monitoring. Footage is reviewed only when necessary.

Guests are responsible for their personal belongings. The owners and hosts are not liable for:

  • theft or loss of personal items,

  • damage caused by weather, wildlife, or natural conditions,

  • items left unattended inside or outside the villa.

5. Pets (If Applicable)

Guests who bring pets agree to full responsibility for:

  • their pet’s safety (the property is not fully enclosed),

  • supervision at all times,

  • any damage caused by their pets,

  • protecting the dune wildlife and ecosystem.

Owners and hosts assume no liability for injuries to pets or incidents involving pets on or off the property.

6. Website Information & Accuracy

All information on the website (photos, descriptions, amenities, features, local recommendations, etc.) is provided in good faith. However:

  • features may vary,

  • temporary maintenance or changes may occur,

  • availability of amenities is not guaranteed at all times.

The owners are not liable for discrepancies, updates, or changes that occur due to maintenance, repairs, change in circumstance, last minute changes or circumstances beyond control.

7. Indemnity

By booking and/or staying at Sunset Beach Villa, you agree to indemnify and hold harmless:

  • the owners

  • hosts

  • representatives

  • staff

  • service providers

from any claims, demands, losses, damages or liability arising from your stay, including:

  • injury or death

  • accidents or incidents

  • improper use of facilities

  • non-compliance with rules

  • actions of children, pets, or visitors

  • natural or environmental events.

8. Third-Party Bookings & Agents

If your booking is made through a rental agent or booking platform (e.g., Airbnb, Booking.com, VRBO etc):

  • the agent is not liable for any aspect of your stay

  • these terms still apply in full

  • the villa’s own rules and disclaimers supersede any conflicting third-party policies.

9. Right to Refuse Service

The owners reserve the right to:

  • decline a booking

  • cancel a booking due to rule violations

  • terminate a stay for behaviour causing danger, disturbance, property damage, or breaking House Rules (including noise regulations).

No refunds will be issued for dismissals due to guest misconduct.

10. Governing Law

These terms are governed by the laws of the Republic of South Africa.
Any disputes arising will be resolved within the relevant South African jurisdiction.

11. Wildlife & Environmental Disclaimer

Sunset Beach Villa is located beside a protected nature reserve and coastal dune ecosystem, which is home to small wildlife such as field mice, geckos, snakes, tortoises, porcupines, and coastal birds. These animals naturally inhabit the surrounding area and do not indicate any form of bother or infestation within the property.

While the villa is professionally cleaned, maintained, and pest-controlled, occasional sightings of small wildlife may occur, especially if:

  • doors or windows are left open,

  • food is left accessible,

  • outdoor conditions (wind, temperature, seasons) encourage natural movement.

These occurrences are normal for properties bordering natural reserves and do not constitute a defect, infestation, or grounds for refund or compensation.

By booking and staying at the villa, guests acknowledge and accept:

  • that the presence of small wildlife is a natural environmental factor beyond the owners’ full control,

  • that such wildlife does not represent a hygiene or safety failure,

  • that responsibility lies with guests to keep doors closed and food secured,

  • and that any wildlife entering due to guest actions (e.g., leaving doors open) is not the responsibility of the hosts.

The owners and hosts are not liable for any discomfort, inconvenience, or claims arising from natural wildlife in the area or accidental entry into the property.

12. Cookie Policy

Sunset Beach Villa’s website uses cookies and similar technologies to improve your browsing experience, analyse website traffic, and ensure the site functions correctly.

13. Booking & Cancellation Policy

Deposit:

A 50% deposit is required to confirm the booking. This deposit is non‑refundable.

Balance Payment:

The remaining balance is due 30 days before check‑in. Once paid, the balance is also non‑refundable.

 

Damages Deposit:

A R50,000 refundable damages deposit is payable 30 days before check‑in. This deposit will be refunded 7 business days after check‑out, provided no damage, loss or additional charges are incurred.
