1. Acceptance of Terms
By making a booking at Sunset Beach Villa (“the Property”), you (“the Guest”) confirm that you have read, understood, and agree to these Terms, as well as all House Rules and Policies.
These terms apply to all bookings, regardless of whether the reservation is made via:
-
the official website,
-
Airbnb, Booking.com, or other platforms,
-
a rental agent or third party, or
-
direct communication with the host.
Occupying the Property constitutes full and binding acceptance of these terms. The House Manual is available at the Property and forms part of these Terms.
2. Use of Property & Assumption of Risk
Use of the Property and all facilities is entirely at the Guest’s own risk. This includes, but is not limited to:
-
swimming pool, pool deck, and pool cover,
-
wood-fired hot tub and firebox,
-
stairs, balconies, and elevated areas,
-
braai areas, fireplaces, and cooking equipment,
-
outdoor showers, gardens, and beach access paths,
-
surrounding natural environment, including weather, wind, sand, and wildlife.
To the fullest extent permitted by South African law, the owners, hosts, and their representatives shall not be liable for any injury, loss, damage, or incident arising from the use of the Property.
Parents/guardians must supervise children at all times.
3. Property Damage & Additional Charges
Guests are responsible for treating the Property with care and are financially liable for:
-
any damage to the Property or its contents,
-
misuse of appliances or equipment,
-
damage to outdoor features (including pool systems, decking, furniture, doors, and windows),
-
pet-related damage,
-
excessive cleaning or restoration required due to negligence.
All damages will be charged at fair repair or replacement cost. Guests must report any damage immediately.
4. Security, Cameras & Personal Belongings
The Property is fitted with outdoor-only security cameras for safety purposes.

No cameras are installed inside the home or in private areas.
-
Footage is accessed only when reasonably necessary.
While reasonable security measures are in place, Guests are fully responsible for the safety and security of the Property during their stay, including ensuring that doors, windows, gates, alarms, keys, remotes, and all access points are properly secured at all times.
For additional peace of mind, private on-site security can be arranged on request at an additional cost.
Guests are also solely responsible for their personal belongings. The owners and hosts are not liable for any theft, loss, or damage, including where this results from failure to adequately secure the Property.
5. Pets (If Applicable)
Guests bringing pets accept full responsibility for:
-
supervision at all times,
-
their pet’s safety (the Property is not fully enclosed),
-
any damage caused,
-
ensuring no harm to local wildlife or the surrounding environment.
The owners and hosts accept no liability for pet-related incidents.
6. Website & Listing Accuracy
All descriptions, photos, and information are provided in good faith. However:
-
features and amenities may change,
-
maintenance or unforeseen issues may occur,
-
availability of specific amenities cannot be guaranteed at all times.
Such variations do not constitute grounds for refund or liability.
7. Indemnity
The Guest agrees to indemnify and hold harmless the owners, hosts, staff, and representatives from any claims, damages, losses, or liabilities arising from:
-
injury, death, or accidents,
-
use or misuse of the Property,
-
breach of these Terms or House Rules,
-
actions of guests, visitors, children, or pets,
-
natural or environmental factors.
8. Third-Party Bookings
Where bookings are made via third parties (e.g. Airbnb, Booking.com, agents):
-
those parties are not responsible for the stay itself,
-
these Terms apply in full,
-
these Terms take precedence over conflicting third-party policies where legally permitted.
9. Right to Refuse Service / Terminate Stay
The owners reserve the right to:
-
refuse or cancel bookings, or
-
terminate a stay without refund
in cases of misconduct, rule violations, excessive noise, damage, or behaviour posing risk or disturbance.
10. Noise Policy
Guests are required to respect neighbours and the residential nature of the area at all times.
-
Quiet hours are strictly observed between 22:00 and 08:00
-
No parties, events, or excessive noise are permitted at any time
-
Noise levels must be kept reasonable at all times, including in outdoor areas
Failure to comply may result in immediate termination of the stay without refund, and guests may be liable for any fines or complaints incurred.
11. Governing Law
These Terms are governed by the laws of the Republic of South Africa. Any disputes will be subject to South African jurisdiction.
12. Wildlife & Environmental Disclaimer
The Property is located alongside a protected coastal environment and natural dune system.
Guests acknowledge:
-
occasional presence of small wildlife (e.g. geckos, insects, rodents, snakes, birds),
-
this is a natural environmental condition and not a defect,
-
such occurrences do not constitute grounds for refund or complaint.
Guests are responsible for keeping doors/windows closed and food secured.
The owners and hosts are not liable for any inconvenience or claims relating to natural wildlife.
13. Booking, Payments & Cancellation
Deposit:
A 50% deposit is required to secure the booking.
Cancellation:
-
Deposits are non-refundable.
-
However, at the owner’s discretion, bookings may be moved to alternative dates subject to availability.
Balance Payment:
The remaining balance is due 30 days prior to check-in and is non-refundable.
Damages Deposit:
A refundable damages deposit of R20,000 is payable 30 days prior to check-in.
This will be refunded within 7 business days after check-out, less any applicable deductions.
